Professor Jennifer McKay AM is Professor of Business Law at the University of South Australia-Justice and Society and was awarded an AM in the King's birthday honours list on 12 June 2023 for services to the law and legal profession. She has conducted research and taught at Melbourne, Adelaide , James Cook Universities and the University of South Australia and has an adjunct appointments as Professor of Law at ANU ( College of Law) and the University of Fiji. She worked as a legal practitioner and held, for over 25 years, a part time appointment as a Commissioner of the Environment Resources and Development court in SA . She is a finalist in the Women in Law Awards of Lawyer's Weekly, as academic researcher and for contributions to legal education. The Inter governmental Panel on Climate Change(IPCC) Australian Focal Point Advisory Panel has nominated me( September 2024) to be a lead author on a IPCC report on climate change.
Professor McKay is a socio legal and doctrinal legal researcher with over 180 publications in the areas of natural resources management law, and environmental laws to achieve ecologically sustainable development especially with regard to freshwater. She looks at human rights instruments and domestic laws and makes ( many) law reform suggestions to improve institutional arrangements applying gender, disability and social inclusion lens to laws . She is now championing the inclusion of a right to a clean healthy environment in a potential Human Rights Act for SA. She has had several projects in Australia funded by the ARC and several CRC' s (Water quality and treatment, Irrigation futures, Race 2030) and national bodies such as ACIAR, Goyder Institute, National Centre of Excellence in Desalination, National Groundwater Centre of Excellence, Australian Water Partnership on Vietnam and international bodies such as the World Bank,UNESCO,OECD and the Australian-American Fulbright Foundation. She has received substantial funding from these bodies over many years and currently.
She is research ethics advisor in Justice and Society .

In 2021, she secured a the New Colombo Plan Study tour project . This took place in 2023 and examined environmental law issues such as Plastic pollution and international law in Fiji and took a comparative and human rights based law approach to domestic Fiji law on water law and environmental management especially tourism. This took place with Sue Milne in April 2023 for 2 weeks and involved University of Fiji as partners and 17 UniSA law students.
In 2023 and 24, she convened the Australian Law Research Awards on behalf of Council of Australian Law Deans.
She has appeared before Royal Commissions and Commissions of Enquiries into land and water management.

Professor McKay enjoys teaching and is experimenting with new ways of delivering complex and changing materials in face to face and online settings and is engaged in scholarship of this through a Graduate Certificate in Educational Studies(online learning). This is through the Teaching Innovation Unit at UniSA.She is also mentoring other academics in Iran in introducing Master of Environmental law courses.

She has a BA Hons and PhD from the University of Melbourne where she used social science methods to research water and environmental management, an LLB from Adelaide, GDLP from UniSA , Diploma in Human Rights Law from American University in Washington DC and the Grad Certificate in education ( online learning). She practiced Commercial law for a large firm in Adelaide.
She has supervised 14 Phd students and has been given the award of the 2019 Supervisor of the Year by UniSA https://www.unisa.edu.au/unisanews/2019/november/story12/for going above the call of duty.Professor McKay has also won UniSA research excellence awards twice in 2008 and 2011. She has also had several awards from industry bodies such as the Australian Water Association and the Water Industry Alliance. In 2008, she was placed by Minister Rankine on the Women's Honour Roll in SA for services to water law and policy.
Over many years and with the assistance of the Library and Learning Centre, she has created a collection of water law and policy books. This collection has been benchmarked and is of international merit.

In February 2021, UniSA hosted the 7th Frontiers in Environmental Law colloquium. see https://www.unisa.edu.au/Calendar/7th-frontiers-in-environmental-law-colloquium/
This event had 6 rapportuers in 20 sessions with over 40 speakers and 30 other guests and discussions were lively.
The first plenary on the Adelaide International Bird Sanctuary was were supported by the Department for Environment and Water. Jason Irving, Manager National Parks and Protected Areas Program made a presentation on the local issues surrounding this relatively new sanctuary for migratory and resident shorebirds. There are some contentious local issues with brine pollution killing mangroves in the Sanctuary and this provided environmental law in action perspective to the event. The CEO from East
Asian- Australasian Flyway treaty body https://www.eaaflyway.net/ based in Korea also presented on the treaty actions.
Hence, we had a span of interest from local to international. Discussants for this session included a local Greens member of parliament Mark Parnell and Craig Wilkins from the local Conservation Council of SA. This was a wonderful session bridging the local and state and international aspects of migratory birds and coastal land management.
The second plenary on climate conscious lawyering was presented by Justice Preston of the NSW Land and Environmental Court. This paper was inspiring for all in the room. The Environmental Defenders office through Rachael Walmsley NSW also contributed a thought provoking paper on the proposed amendments to the EPBC Act.

Teaching environmental law and the laws regulating Australian business forms is a complex task with frequent changes to laws. There are many pressures on the federal structure and many conflicting viewpoints.
Professor McKay has engaged with judges and former Law Reform Commissioners and incorporates video vignettes in to class on current and potential future directions of environmental law and Corporate law and regulation. She seeks to make the teaching commercially realistic by drawing on colleagues ( from her former firms) to assist with real world case examples which often form assessment tasks. Professor McKay has recently completed with, High Distiction ,a short course called Effective online Learning( at UniSA) and she is adapting tools to create an exciting online and face to face delivery. She is supported by the program leaders and the Library to innovate and is sharing her learning with her colleagues. The Covid pandemic has created opportunities for learning environments to change.
Professor McKay has been involved in the programs to induct new staff into research supervision for over 5 years and has delivered a reflective talk over 15 times. She then answers questions and engages in discussions to assist development of skills in Research supervision. She has done this for the Teaching Innovation Unit.
She has completed the training and is a Peer reviewer of UG teaching since June 2019.
Prof McKay's method of teaching in Environmental and Natural resources law and International and comparative environmental law uses many forms of communication including ones she commissioned. The Learnonline sites have been used in the TUI at UniSA as an exemplar of good practice.
She is completing a Graduate Diploma in educations studies (online learning) through UniSA .
In 2021 she will lead law students on a New Colombo Plan field trip to Fiji to look at domestic and international environmental law with a focus on climate change and plastic pollution
